Electronic Mail — Jasper County, IA, Attorney Scott Nicholson — 03 JUN 2025

Jasper County, IA Attorney Scott Nicholson,

I have verified with your staff the proper address for serving you a subpoena. I now require only your requested travel expenses to the Marshall County, IA, Courthouse pursuant to Iowa Administrative Code r. 191-3.14 and Iowa Code § 622.69, 622.74, and 602.1509.

Subpoena Servicing Location and Origination of Travel for Jasper County, IA, Attorney Scott Nicholson
Attorney’s Office
114 W. 3rd St. N.
Newton, IA 50208

Marshall County Courthouse
1 E Main St
Marshalltown, IA 50158

As shown in the chest camera footage below, I was unable to verify where to serve Jasper County, IA, CIO Ryan Eaton a subpoena or what his travel fees would be. I also require the identity of the Jasper County employee (see: attached photos) who has a documented history of unprofessionalism during a public records request—and who allegedly provided false information to obstruct the service of a subpoena. I intend to subpoena this individual and question them in court regarding the evidence of their historical public service.

Please inform all Jasper County, IA, staff:
If they wish to appear in court to explain the evidence of their historical conduct, then by all means—continue producing what the record increasingly suggests are deliberate misrepresentations and time-wasting responses.

That’s what I love about the Jasper County, IA, Attorney’s Office: when the evidence indicates you’re mired in unethical conduct, you’re all on it—like cardinal droppings in a dark alley. Yet when an injured party prepares public records requests or lawful civil documentation to subpoena your office (to properly authenticate evidence pursuant to Iowa Rules of Court Chapter 5) it seems suddenly no one can be found.

Respectfully,

Michael J. Merritt, USN (Ret.)
